EVIT Legal Update

Evit Legal Update

Apache Junction Unified School District is committed to providing clear and accurate information regarding our recent participation in a lawsuit involving the East Valley Institute of Technology (EVIT). While AJUSD has long supported Career & Technical Education (CTE) programs—both on our campuses and through EVIT—recent proposed changes by EVIT raised concerns about long-term student access, academic credit, and the use of voter-approved funding. After nearly a year of unsuccessful efforts to resolve these issues collaboratively, AJUSD and eight other East Valley school districts turned to legal action as a last resort. No changes are occurring for students at this time, and all existing CTE programs continue without interruption. This page provides the full legal statement and answers to common questions so families can understand the facts and follow developments as they occur.

FAQ: EVIT LEGAL ACTION

Because there has been public discussion and confusion about AJUSD’s role in a legal filing involving EVIT, we are providing this FAQ to clarify the facts. The answers below explain the purpose of the lawsuit, why AJUSD joined it, and how it relates to Career & Technical Education (CTE) programs. Transparency is important, and we are committed to keeping our community accurately informed.

  • Because the lawsuit is a matter of public record, and misinformation is already circulating. It’s important that families receive accurate information directly from the district.

  • No. AJUSD values EVIT and the opportunities it provides. The legal action is not about ending the partnership—it is about protecting student access, credit, and taxpayer-funded programs.

  • No. All current CTE programs remain available. Students may continue enrolling in courses at AJUSD or EVIT just as they have in the past.

  • No. The lawsuit was filed, in part, to prevent changes that could have jeopardized academic credit. One of AJUSD’s primary goals is protecting earned credit and graduation pathways.

  • After nearly a year of requests for collaboration, mediation, and joint problem-solving, EVIT declined to engage meaningfully with the concerns raised by multiple districts. Legal action was taken only when no other path remained.

  • EVIT signaled intentions to:

    • Limit access to certain CTE programs unless taken exclusively at EVIT campuses

    • Remove or deny academic credit unless an entire multi-year program was completed

    • Redirect voter-approved funds away from local school programs

These proposals could have reduced program options and increased graduation risks for students.

  • Partly. Voters approved tax dollars to support local participation in EVIT. The district expects those funds to be used responsibly and transparently, in alignment with voter intent.

  • Yes. AJUSD continues to cover transportation costs for students who choose to attend EVIT.

  • Legal timelines vary. We will provide updates when there is new information to share.

  • Nothing changes. Continue planning your student’s CTE pathway as normal.

CTE pathways shape futures.

AJUSD is making sure every student keeps access to theirs.
